These Terms and Conditions (the “Terms”) govern the relationship between CAR VX GROUP (“CAR VX”, “we”, “us”) and any person using the website carvx.be (the “Site”) or purchasing a vehicle history report (the “Customer”).
The Site provides access to vehicle information reports (the “Reports”) through an online service (the “Service”).
Terms and Conditions
Introduction
1. Acceptance of the Terms
By using the Site, the Customer fully accepts these Terms.
CAR VX reserves the right to modify these Terms at any time. Changes take effect upon publication on the Site.
2. Formation of the Contract
The information available on the Site does not constitute a binding offer. A contract is formed when the Customer submits an order and the payment is successfully processed.
CAR VX reserves the right to refuse or cancel any order in case of issues, including payment failure or suspected fraud.
3. Personal Data (GDPR)
CAR VX processes personal data in accordance with the General Data Protection Regulation (GDPR).
Data may be used to provide the Service, manage orders, improve user experience, and communicate with the Customer.
The Customer has the right to access, rectify, and delete their personal data by contacting CAR VX.
4. Access to the Site
The Site is accessible via the Internet. CAR VX does not guarantee uninterrupted or error-free access.
The Customer is responsible for securing their own device and protecting it from viruses or other threats.
5. Intellectual Property
All content on the Site and in the Reports, including texts, data, logos, and graphics, is protected by intellectual property rights.
Any unauthorized use, reproduction, or distribution is strictly prohibited.
6. Use of the Service
The Customer agrees to use the Service only for lawful purposes and in compliance with these Terms.
Any abusive, fraudulent, or unauthorized use is prohibited.
7. Availability
The Service depends on external systems and data sources. CAR VX does not guarantee continuous or uninterrupted availability.
8. Delivery of Reports
Reports are provided after order validation and successful payment.
CAR VX reserves the right to suspend or deny access in case of misuse.
9. Use of Reports
Reports are provided for personal or internal business use only.
The Customer may not resell, modify, reproduce, or distribute the Reports without prior authorization.
10. Pricing and Payment
Prices are indicated on the Site and may be modified at any time. Payment is required before accessing the Reports and is processed via secure third-party providers.
By confirming the order, the Customer expressly requests the immediate execution of the Service and acknowledges that access to the Report results in the loss of the right of withdrawal in accordance with applicable law.
11. Right of Withdrawal and Refunds
The Customer has the right to withdraw from the contract within 14 days without providing any reason.
To exercise this right, the Customer must send a request by email to support@carvx.be, including the order number, purchase date, and contact details.
Refunds will be processed within 14 days using the same payment method. As a commercial gesture, CAR VX may extend this period to 30 days, subject to the conditions below.
The right of withdrawal does not apply if the Report has been accessed, if any credit has been used, or if the Service has been fully performed.
By accessing the Report, the Customer acknowledges that the Service has started and accepts the loss of the right of withdrawal.
If a Report contains no usable historical data, CAR VX may grant a credit allowing the Customer to check another vehicle. No monetary refund will be issued in such cases.
A Report is considered used once it contains any data, including mileage, damage, or vehicle history information.
13. Limitation of Liability
The Service is provided “as is” without warranties of any kind.
CAR VX shall not be held liable for decisions made based on the Reports, nor for any direct or indirect damages, including financial losses resulting from the use of the Service.
14. Termination
CAR VX may suspend or terminate access to the Service at any time in case of breach of these Terms.
